("ALR" and Land Reserve Commission)

  1. The Planning Department of the Regional District can tell you if your land is in the "ALR" and is affected by the Agricultural Land Commission Act and Regulations. Land within the ALR can be used only for farm use, cannot be subdivided and under most circumstances can only have one single family dwelling upon it, unless you obtain permission from the BC Provincial Land Reserve Commission.
  2. If land is within a designated ALR and you wish to appeal the designation, you may do so by following one of the procedures below:
    1. Appeals to remove land from the ALR under Section 9(2) of the Agricultural Land Commission Act, are made through the Regional District Office. The Planning Department can assist you with this application.
    2. Appeals under Section 11(4) of the Agricultural Land Commission Act to allow non-agricultural uses on ALR land or subdivision within ALR, but to retain the land within the ALR are also made through the Regional District Office.
    3. Certain land uses are permitted within the ALR on a conditional basis. Application to carry out one of these conditional uses can be made directly to the Land Reserve Commission by filling out a form available at either their office or the Regional District Office.

  3. If this sounds confusing, you may want to talk to the Land Commission staff or the Planning Department of the Regional District. In both offices a copy of the Agricultural Land Commission Act is available.
